READ before you COMPLAIN to MLS.
This is a multiple offer situation or officially known as an auction. I am a licensed real estate Auctioneer. I can officially and legally conduct an auction. If you do not understand the conduct of an auction or the rules of the terms and conditions, I kindly ask that you read those before making quick assumptions. An evident fact is most REALTOR®s do not read the information.
To, in any manor, downgrade real estate auctions is a violation of the Code of Conduct. To take action to elevate an auctioneer from doing business is restraint of trade and violation of the Sherman Antitrust Act. To hinder an auctioneer from collecting offer is bid suppression, and for two or more to create a circumstance to hinder the auctioneer from offers is conspiring to bid rig, which is a violation of all the above plus the Clayton Act.
Just because you get Zillow leads and you don’t like it because they called for an auction does not give you the right to suppress the bidding or restrain my business.
Of course, this is not meant for everyone. But for those who wish to make undocumented complaints because your too obtuse to participate does not give anyone the right to violate my rights. Additionally, it is illegal to require the seller to sell for any price, listed or otherwise. That is defined by the DOJ as price fixing.
It is easy to participate. It’s transparent. It’s competitive. It’s authorized by the seller. In the state of Texas, the seller has rights. Refer to the rules of multiple offers. Auctioneers invented multiple offers. So, if you don’t like it, ok, move on. if you would like to earn money, get your buyer involved.
